Notice on the Right to Object under Art. 21 GDPR

You have the right, on grounds relating to your particular situation, to object at any time to the processing of your personal data that is carried out on the basis of Art. 6 para. 1 lit. e or f GDPR (Art. 21 para. 1 GDPR). Where we process your personal data for direct marketing purposes in accordance with Art. 6 para. 1 lit. f GDPR, you have the right to object to this processing at any time without being required to provide reasons (Art. 21 para. 2 GDPR). We will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is necessary for the establishment, exercise or defence of legal claims. § 3 Collection, Processing, and Use of Personal Data during Informational Use

(1) If you visit our website without providing any personal information, we do not know who you are. In this case, we receive only communication data from your browser without any direct personal reference. In such cases, we collect the following data: IP address, date and time of the request, access status/HTTP status code, amount of data transferred, browser, operating system and its interface, language and version of the browser software, the website from which the request originates, the content of the request, and the time zone difference to GMT. This data is collected insofar as it is technically necessary to enable access to our website and to provide the services and features you use that are offered on our website, to analyse, adapt and improve our services, content and advertising, and to ensure stability and security. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f GDPR. The data is stored for a period of six months and then automatically deleted.

(5) The stored information is kept separate from any additional data you may have provided to us. Specifically, cookie data is not linked to your other data, provided such data has been transmitted to us.

§ 4 Collection of Personal Data for Personalized Use; in Particular Contact Forms and Applications

(1) In addition to the purely informational use of our website, we offer various services that you can use if interested. To do so, you are generally required to provide additional personal data, which we use to provide the respective service. If additional voluntary information can be provided, it is marked accordingly. We only collect, process, and use the personal data that is necessary for your use of the website, for responding to an inquiry, and/or for fulfilling a contract concluded with us, or that you voluntarily provide. This includes, in particular, the following inventory and usage data, which may be transmitted via forms on our website: first and last name (including title, academic degree, first name and surname), company/institution name, address and email address.

(2) If you contact us by email or via a contact form, we store the data you provide in order to respond to your enquiry and for any follow-up questions. A valid email address is required so that we know who the inquiry is from and can respond to it. Further information may be provided voluntarily. Your enquiries are stored for a period of one year after they have been answered. Insofar as they constitute business correspondence within the meaning of commercial or tax law, we retain the correspondence for the legally prescribed periods (usually six years).

(3) You may submit your application for the job postings listed under the “Careers” section of our website. If you send your application to us by email, please note that emails are transmitted to us without encryption. This means that unauthorized third parties may potentially gain access to your data. If you do not wish to take this risk, you should send your application by post to the address specified in the job posting. We process the personal data that you provide to us throughout the entire application process (for example, in your cover letter, résumé, references, applicant questionnaires, interviews). The data processing is carried out pursuant to § 26 para. 1 sentence 1 of the Federal Data Protection Act (BDSG) for the purpose of conducting the application process (“decision on the establishment of an employment relationship”). Unless you have consented to the retention of your data beyond the end of the specific application process, we will delete your data six months after the conclusion of the application process. The application process is considered concluded when the period in which legal action for violations of the General Equal Treatment Act (AGG) could still be expected has expired (usually five months after the rejection was sent, unless a claim under § 15 para. 4 AGG has been submitted by then).

§ 5 Transfer of Personal Data to Third Parties

(1) We make partial use of external service providers or other services, namely hosting providers, statistical and analytics services, as well as IT maintenance and development service providers.

(2) In doing so, we fully comply with all applicable data protection regulations and, where necessary, contractually require our service providers to do the same.

(3) Beyond this, we do not share your personal data unless an authority is exceptionally entitled to request it, for example, for law enforcement or threat prevention purposes.

(4) The aforementioned processing activities may also result in the transfer of data to recipients located outside the European Union (see below: Google Analytics). § 6 Use of Google Analytics

(1) This website uses Google Analytics, provided that its use has been enabled under the website’s privacy settings (subsection: analytics cookies). Google Analytics is a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and that allow an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to a Google server in the United States and stored there. In the event that IP anonymization is activated on this website, your IP address will, however, be shortened by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area before transmission. § 7 Use of Google AdSense

§ 8 Use of Google Tag Manager

§ 9 LinkedIn

(1) Our company maintains an online presence on LinkedIn. The provider is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.

This is a subsidiary of LinkedIn Corporation, 1000 W. Maude Avenue, Sunnyvale, CA 94085, USA.

(2) If the use of LinkedIn has been activated in the website’s privacy settings (under "Analytics Cookies"), it is possible that user data may be processed outside the European Union, particularly in the United States. This may make subsequent access to user data more difficult. We do not have access to this data, as it is managed exclusively by LinkedIn.

§ 10 Newsletter

(1) By subscribing to our newsletter, you agree to receive newsletters and updates from us. These may include updates on the latest developments in the e-learning industry, as well as information about FKC and the promotion of our own products and services.

(2) Subscription to our newsletter follows the double opt-in process. After registering, you will receive an email at the address you provided, requesting confirmation of your subscription. Your subscription must be confirmed within 24 hours; otherwise, your information will be blocked, and after one week, it will be automatically deleted.

(3) To subscribe to the newsletter, only your email address is required. Providing additional data is voluntary and is used solely for personalized communication. Once you confirm your subscription, your email address will be stored for the purpose of delivering the newsletter. Additionally, your IP address and the timestamps of your registration and confirmation will be recorded to verify your subscription and prevent potential misuse of your personal data. The legal basis for this processing is Art. 6 (1) sentence 1 lit. a GDPR.

(4) Your consent to receive the newsletter can be withdrawn at any time. You can unsubscribe from the newsletter service at any time via the “Newsletter Unsubscription” page on our website or by using the link provided in each newsletter email.

§ 11 Embedding of YouTube Videos

(1) We have embedded YouTube videos on our website. These videos are stored on http://www.youtube.com and can be played directly from our website. All embedded videos use "enhanced privacy mode", which means that no data about you as a user is transmitted to YouTube unless you actively play the videos. Data is only transmitted once you start playing a video, as described in paragraph 2 below. We have no control over this data transmission.

(2) When you visit a subpage of our website that contains a YouTube video, YouTube receives information about this visit. Additionally, the data mentioned in § 3 of this privacy policy are transmitted. This occurs regardless of whether you have a YouTube account or are logged in to YouTube. If you are logged in to a Google account, your data are directly associated with your profile. To avoid this association, you should log out of your Google account before playing a video. YouTube stores the collected data as user profiles and uses them for purposes such as advertising, market research, and personalised website design. This analysis is conducted even for users who are not logged in. Other social network users may also be informed about your activity on our website. You can object to the creation of such user profiles directly with the respective social media provider.

(3) The legal basis for the use of YouTube is Article 6(1)(f) GDPR, as embedding YouTube videos serves the legitimate interests of the website operator. These interests include the provision of customised advertising and informational content through YouTube videos, as well as informing other social network users about activities on our website.

§ 12 Protection of Personal Data

We implement technical and organisational measures in accordance with the requirements of Article 32 GDPR to protect users’ personal data. All employees involved in the processing of personal data are bound by data confidentiality. Personal data transmitted to our website is encrypted using HTTPS to ensure secure transmission.

§ 13 Legal Basis

In accordance with Article 13 GDPR, we inform you about the legal basis for our data processing activities:

• If we obtain consent from the data subject for the processing of personal data, Article 6 (1) lit. a GDPR serves as the legal basis.
• If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, Article 6 (1) lit. b GDPR serves as the legal basis. This also applies to processing operations required to take steps prior to entering into a contract.
